The company NEW 2000 (as defined in Article 1 below), operating under the Place du jour brand, sells ready-to-wear items on its website www.placedujour.fr.

In order to offer for sale, sell, and deliver its products, NEW 2000 collects personal data from users of its website, its mobile application, and its customers when they make purchases at the physical store.

The purpose of this privacy policy is to inform users of the means implemented to collect, access, process, and retain users' personal data.

NEW 2000, as data controller, undertakes to comply with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and with French law n°78/17 of 6 January 1978, as amended (known as the "Data Protection Act").

The User is informed that certain Data must be collected by NEW 2000 in order to provide its products and services. If the User does not wish to provide this data, NEW 2000 will not be able to carry out its services.

This privacy policy (the "Policy") may be amended at any time by NEW 2000, in particular to comply with any regulatory, case-law, editorial, or technical developments. Before browsing, the User should refer to the latest version of the Policy.


1. THE DATA CONTROLLER

The data controller, which collects personal data and carries out Data processing, is: NEW 2000, a limited liability company (société à responsabilité limitée) with capital of €100,000.45, registered with the Bobigny Trade and Companies Register under number 348 927 344, whose registered office is at 8 rue de la haie coq, 5 rue Saint Gobain in Aubervilliers (93330), France (hereinafter the " Publisher " or the "Data Controller"). 

For the purposes of this Policy, the terms "Process" or "Processing" refer to any operation or set of operations performed on Data, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, restriction, erasure, or destruction.

The term "Data" refers to any information relating to an identified or identifiable User, in particular by reference to an identifier such as a name, an identification number, location data, or one or more factors specific to that person.



2. COLLECTION OF PERSONAL DATA

NEW 2000 may collect users' personal data on the website www.placedujour.fr.

The personal data that may be collected are as follows:

  • User account data: namely the data the User provides when creating an account by filling out the registration form (first name, last name, billing and delivery postal addresses, email address, mobile phone number);
  • Personal data of the User when entered in the customer account: date of birth, clothing size;
  • Transaction data: refers to the User's information relating to orders placed and returns, such as their phone number, address, email address, and information relating to their payment method;
  • Exchanges with customer service;
  • Browsing data: refers to the data the Publisher collects while the User browses the Sites and Applications, such as, in particular, the date, time of connection and/or browsing, browser type, browser language, IP address, location and geolocation data;
  • Personal data of contest participants: when you take part in a contest on our social media channels, we may retain the personal data of the winners.

Data relating to payment methods (card number, expiration date, authorization number, security code) is collected directly by our provider Shopify Payments. NEW 2000 never has access to its customers' payment data.

Third-party application providers linking to our Sites and/or mobile applications, as well as the networks on which we publish content (such as Facebook and Instagram), may also use automated tools to collect User data (profiling of online activity). This data collection is carried out directly by these providers and/or third parties and is subject to their own policies. To the extent permitted by applicable law, NEW 2000 is not responsible for the practices of these providers and third parties.


Certain services may be impaired or inaccessible without consent to the collection of the Data mentioned in this Privacy Policy.



3. PURPOSES OF THE COLLECTION OF PERSONAL DATA

The Data collected in connection with use of the Site is Processed in order to fulfill the purposes described in the table below.

Applicable regulations protect Users' privacy and require any data controller to be able to justify a legitimate basis for such processing. The regulations accordingly provide, among the legal bases for processing:

  • performance of a contract to which the data subject is party, such as a sales contract. Certain personal data of the User is accordingly necessary to deliver the goods, manage the customer account, and process returns;
  • compliance with a legal obligation, in particular accounting obligations through the retention of invoices;
  • the prior consent of the data subject;
  • the legitimate interest of the data controller, with due respect for users' rights and freedoms. Improving the customer experience or preventing fraud may accordingly justify the collection of Data.

Customers' personal data is collected for the following purposes:
  • Managing orders and product sales and providing services; managing complaints, cancellations, and product returns;
  • Informing Customers of offers and marketing communications relating to the brand;
  • Strengthening and improving communication about the Website and the brand by sending, in particular, newsletters and special offers based on the Customer's preferences observed on the Site;
  • Improving and personalizing the services offered to Customers;
  • Complying with legal and regulatory obligations.


NEW 2000 does not share any personal Data with third parties for commercial purposes.

The User may change their personal Data and withdraw their consent at any time by logging into their customer account.

 

4. Providers with access to users' personal data

The personal data collected is transmitted to NEW 2000's providers, who may process it on behalf of NEW 2000 (data processors) and/or on their own behalf (data recipients).


The data recipients are:

  • Shopify Payments, payment provider
  • any police or administrative authority as part of judicial requisitions relating to the fight against fraud
  • customs services and providers in the event of delivery abroad. 


NEW 2000's data processors may have access to the data collected for:

  • the preparation, shipping of orders, and the return of products
  • improving the content of the website
  • maintenance and technical development operations for the website, the mobile application, and NEW 2000's internal applications, including entities that fulfill orders and provide web hosting, information storage, email service providers, as well as analytics and tag management services, such as Google Analytics.

5. USERS' RIGHTS REGARDING THEIR PERSONAL DATA

In accordance with Articles 14 to 22 of Regulation 2016/679 of 27 April 2016, any natural person using the Place du jour website or mobile application may exercise the following rights:

  • A right of access, rectification, and deletion of the data collected,
  • A right to object to the processing of their data
  • A right to restriction of processing,
  • A right to portability of the data collected
  • The right to issue instructions regarding the retention, erasure, and disclosure of their personal data after their death, in accordance with Article 40-1 of the Data Protection Act.


Finally, if NEW 2000 becomes aware of a Data breach likely to result in a high risk to the rights and freedoms of its Users, it undertakes to inform the affected users as soon as possible, as well as the competent supervisory authority, namely the CNIL for France.

6. Data retention period

Users' Data will not be retained beyond the period strictly necessary for the purposes pursued as set out herein, in accordance with applicable regulations and laws. In this regard, Data used for prospecting purposes may be retained for a maximum period of 3 years from the closure of the User's account or the last contact with the prospect concerned. User data is deleted once the retention periods expire. 

Nevertheless, certain Data may be archived beyond the periods provided for the purposes of investigating, establishing, and prosecuting criminal offenses, solely in order to make such data available to the judicial authority as needed.

Archiving means that this Data will be anonymized and will no longer be accessible online.

 

7. Security measures for the personal data collected

As Data Controller, NEW 2000 undertakes to take all appropriate precautions to preserve the security and confidentiality of the data, and in particular to prevent it from being altered or distorted, or from being accessed by unauthorized third parties.

NEW 2000 has entered into service agreements with partners with recognized expertise in the field of data protection.

All Data is hosted in France or within the European Union.


Payment providers

Payment for purchases on the website and mobile application is made via the secure platform of our payment provider Shopify Payments.

NEW 2000 never has access to customers' payment data.

The User may choose to save their payment card details in their customer account. This data is not stored by NEW 2000, but by Shopify. The User may modify or delete this banking data at any time by logging into their customer account.

 

8. COOKIES, tags, and trackers

The Site uses cookies, which the user is informed of upon arriving on the website, and which record information relating to the computer's browsing on the website. These cookies are only installed after acceptance by the user; continuing to browse the website constitutes acceptance.

Cookies are used to track browsing or analyze user behavior, in particular to:

  • save information relating to the customer account when the user is logged in;
  • save the shopping cart for 30 minutes;
  • personalize the display of content accessible to the user;
  • measure traffic to our website and application, as well as to their content.

The User is informed that content published on these social networks may be seen by any third party, and that Users should exercise increased caution when providing certain personal Data on these sites or applications, such as financial data, an address, or any other sensitive data. 

    NEW 2000 is in no way liable for any damages caused by third parties as a result of, or arising from, the publication of their personal data by Users.

    The Sites and applications may provide links to sites, applications, and services other than those of NEW 2000, which may be operated by third-party companies.

    NEW 2000 is not responsible for the Processing of personal data by these third-party sites. The User should review their personal data protection policies.
